Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Genadsy — the AI ad-creative studio at genadsy.com (the “Service”). By creating an account or using the Service you agree to these Terms. The Service is provided by:

The service

Genadsy turns product photos and brand inputs into ad creatives — images, layouts and copy — using AI. The Service is intended for business and professional use by agencies, brands and marketers.

Accounts and workspaces

You sign in with a Google account and must provide accurate information. You are responsible for activity in your workspace, including activity by teammates you invite to your seats. Keep your sign-in credentials secure; notify us of any unauthorized use.

Plans, credits and payment

• Paid subscriptions (currently Starter, Growth and Pro) renew monthly and are billed in euros through Stripe. Prices, credit allotments and seat counts for each plan are shown on our pricing page.
• Each billing cycle adds your plan’s credit allotment to your workspace balance; unused credits roll over while your subscription remains active. One-time credit top-up packs are added to the same balance.
• Credits have no monetary value, are non-transferable and non-refundable, and are forfeited when your subscription ends.
• Fair-use limits (such as daily spend caps and rate limits) apply to keep the Service reliable for everyone.
• You can cancel anytime from your billing settings; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments already made are non-refundable.
• We may change prices or plan features with at least 30 days’ notice; changes apply from your next billing cycle.

Your content and generated output

You retain all rights to the content you upload. You grant us a limited license to host and process it solely to provide the Service (including transmitting it to our AI providers to generate your outputs). To the extent we hold any rights in creatives generated for you, we assign them to you: you may use your generated ads commercially, in client work and in paid campaigns, on every plan.

You are responsible for what you upload and generate — you must have the rights to your uploaded content, and you are responsible for ensuring your ads comply with applicable law and advertising rules. AI output can be inaccurate or resemble other content; review creatives before publishing them.

Acceptable use

You may not use the Service to create content that is unlawful, deceptive, infringing, defamatory or harmful; to misrepresent synthetic content as authentic where that is prohibited; to reverse engineer the Service; to resell access to it; or to circumvent usage limits or security measures. We may suspend or terminate accounts that violate these Terms.

Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation — the Service is provided “as is” and “as available”. We may modify or discontinue features; if we discontinue the Service entirely we will give reasonable advance notice.

Liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential damages, lost profits, or lost data. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intentional misconduct or gross negligence.

Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access for material breach of these Terms, with notice where practicable. Sections that by their nature should survive termination (including content ownership, liability and governing law) survive.

Governing law

These Terms are governed by the laws of the Republic of Estonia. Disputes are subject to the jurisdiction of the Estonian courts, with Harju County Court as the court of first instance, unless mandatory consumer-protection rules of your country of residence provide otherwise.

Changes to these terms

We may update these Terms as the Service evolves. Material changes will be announced in the app or by email at least 14 days before they take effect; continued use after that constitutes acceptance.
